By accessing or using the website westpalmbeachsunrooms.com (the "Site") or by requesting or receiving services from WPB West Palm Beach Sunrooms ("we," "us," or "our"), you agree to be bound by these Terms and Conditions. If you do not agree, please do not use this Site or engage our services. These terms apply to all visitors, customers, and others who access or use the Site.
WPB West Palm Beach Sunrooms provides sunroom design, construction, installation, and remodeling services for residential properties in West Palm Beach, Florida and surrounding communities. Services include but are not limited to sunroom additions, patio enclosures, screen room installation, solarium installation, and related construction and renovation work.
All services are subject to a signed written contract between WPB West Palm Beach Sunrooms and the customer. Nothing on this Site constitutes an offer to perform services or a binding contract. A service agreement is only formed when both parties have signed a written proposal or contract.
Any estimate provided by WPB West Palm Beach Sunrooms - whether verbally, by email, or through a written proposal - is based on the information available at the time of the estimate. Estimates are not binding final prices unless they are incorporated into a signed written contract.
Final pricing may vary from an estimate if conditions at the job site differ materially from what was assessed during the consultation, if the customer requests changes to the scope of work, or if unforeseen conditions are discovered during construction (such as pre-existing structural issues, hazardous materials, or site conditions that could not be identified before work began).
Any changes to the agreed scope of work will be documented in a written change order signed by both parties before additional work proceeds. WPB West Palm Beach Sunrooms will not perform additional work beyond the original contract scope without a signed change order.
Project start dates are estimates and are subject to factors outside our control, including permit processing timelines, material availability, weather conditions, and the schedules of subcontractors. We will communicate any delays promptly and work to reschedule in a timely manner.
If a customer wishes to cancel or postpone a project after a contract has been signed, any deposits paid may be non-refundable depending on the terms stated in the written contract and any costs already incurred by WPB West Palm Beach Sunrooms on that project (including permit fees, materials ordered, and design work completed).
WPB West Palm Beach Sunrooms reserves the right to cancel or postpone a project due to unsafe working conditions, non-payment, or circumstances beyond our reasonable control. In such cases, we will notify the customer as soon as practicable.
Payment terms are set forth in the written contract for each project. Typical payment schedules include a deposit at contract signing, one or more progress payments tied to project milestones, and a final payment upon substantial completion. Specific amounts and timing are stated in the project contract.
Payment is due according to the schedule in the signed contract. Late payments may be subject to interest charges as specified in the contract. WPB West Palm Beach Sunrooms reserves the right to suspend or stop work on a project if payments are not made on schedule, and such work stoppages will not constitute a breach of contract by WPB West Palm Beach Sunrooms.
Accepted payment methods will be listed in the written contract. Customers are responsible for all costs of collection if payment obligations are not met, including reasonable attorneys fees where permitted by Florida law.
WPB West Palm Beach Sunrooms will obtain all required building permits as part of the project scope, where included in the written contract. The customer is responsible for providing accurate information about their property, any existing structures, and any homeowners association (HOA) requirements that may affect the project.
If HOA approval is required, the customer is responsible for initiating and managing the HOA approval process, though WPB West Palm Beach Sunrooms may assist with documentation as agreed. Construction will not begin until all required permits and approvals are obtained.
WPB West Palm Beach Sunrooms warrants that all work will be performed in a workmanlike manner consistent with industry standards and applicable building codes. Any specific warranty terms - including duration and coverage - will be stated in the written contract.
Warranties do not cover damage caused by: acts of nature (including hurricanes, floods, or other weather events beyond the design parameters of the project); improper use or maintenance by the customer; modifications made by third parties after project completion; or pre-existing conditions not disclosed prior to contract signing.
Manufacturer warranties on materials, windows, glass, and other products installed by WPB West Palm Beach Sunrooms are governed by the respective manufacturer and are separate from any workmanship warranty provided by WPB West Palm Beach Sunrooms. We will assist in documenting and filing manufacturer warranty claims where reasonably practicable.
To the fullest extent permitted by applicable law, WPB West Palm Beach Sunrooms shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to the services provided or the use of this Site, including but not limited to loss of use, loss of profits, or loss of data.
In no event shall WPB West Palm Beach Sunrooms's total liability to a customer for any claim arising out of a specific project exceed the total amount paid by the customer for that project under the applicable written contract.
If a dispute arises between a customer and WPB West Palm Beach Sunrooms relating to services provided, both parties agree to first attempt to resolve the dispute through good-faith negotiation. If negotiation does not resolve the dispute within 30 days of written notice, the parties agree to pursue mediation before initiating any legal proceeding.
If mediation is unsuccessful, any legal action arising from or relating to services provided by WPB West Palm Beach Sunrooms shall be brought in a court of competent jurisdiction in Palm Beach County, Florida.
These Terms and Conditions and any dispute arising from or related to them or to services provided by WPB West Palm Beach Sunrooms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions.
WPB West Palm Beach Sunrooms reserves the right to update or modify these Terms and Conditions at any time. Changes will be posted on this page with a revised effective date. Continued use of this Site or our services after changes are posted constitutes your acceptance of the updated terms. We encourage you to review this page periodically.
